City of Sequim Sewer Overcharge Resolution

On Monday March 22, 2010 your Board and the City agreed on a means by which HHMC residents who were overcharged for sewer usage may compromise and settle their claims with the City of Sequim.

There is now a procedure in place which enables you to settle any sewer overcharge claims which occurred when the city billed you for using more than 801 cubic feet of water – if in fact you used less than that amount during the period August 2007 thru June 2010.

• The procedure is embodied in two separate agreements:  Facilitating Settlement Agreement, between the City and HHMC; and,
  

• Claim Compromise Agreement With Ratepayer- which is between the City and those HHMC Members who elect to compromise their claim with the City.
  

It is a truism that in all most legal agreements “the devil is in the details”- and these agreements are no exception. So-- you need to read them.

There is no requirement that you utilize this settlement procedure for resolving your claims for sewer overcharges. You are free to pursue other alternatives for obtaining redress. We urge you to consult your lawyer before determining whether and how to proceed.
